General Permit for Napa and Sonoma County Vineyards

The Firm provided strategic CEQA advice and EIR legal review services for a new RWQCB Waste Discharge Requirements General Permit regulating vineyards in the Napa and Sonoma Creek watersheds. The General Permit requires existing and proposed vineyards greater than 5 acres to achieve performance standards for soil erosion in the farm area, and for discharge of nutrients and pesticides. Hillslope vineyard parcels also must achieve performance standards for vineyard storm runoff and for sediment discharge from unpaved roads. Key EIR concerns included water quality benefits of the proposed General Permit and alternatives, and avoiding redundancy with existing local government regulatory requirements.
